All prices are in United States dollars (USD) unless otherwise stated. Payment must be received in full (cleared funds) before we are obligated to ship or provide digital products. You are solely responsible for currency conversion fees, bank charges, taxes, duties, and other costs. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including for suspected fraud or pricing errors.

5. Shipping

We currently offer free shipping on qualifying orders. You are fully responsible for providing accurate shipping information and for complying with all customs, import, and regulatory requirements of the destination country (including Latin America, Europe, and other international destinations). We are not liable for delays, losses, seizures, return-to-sender, or additional costs (including duties, taxes, or storage) caused by incorrect addresses, customs issues, or circumstances beyond our reasonable control. Risk of loss passes to you upon delivery to the carrier. Digital products are delivered electronically and are not subject to physical shipping.

6. Returns & Refunds

Refunds (minus original outbound shipping where applicable) are processed within 5–7 business days after we receive and inspect the items. It may take up to 30 days for the refund to appear on your statement. Products must be returned unused and in original packaging and condition. A restocking fee of up to 15% (or higher if damage is significant) applies if products are not in original condition. We reserve the right to refuse non-compliant returns. Return shipping costs are the customer’s responsibility unless we agree otherwise in writing. Digital products (PDFs) are generally non-refundable once delivered unless required by law.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Subject to the arbitration clause below, you irrevocably submit to the exclusive jurisdiction of the state and federal courts in Miami-Dade County, Florida.

13. Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Miami, Florida. Judgment on the award may be entered in any court of competent jurisdiction. YOU AND HERBAL HEALTH IMB, LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ARBITRATION OR ANY PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If a court or arbitrator finds the class-action waiver unenforceable, the entire arbitration provision shall be void.

14. Indemnification

You agree to indemnify, defend, and hold harmless HERBAL HEALTH IMB, LLC, its affiliates, contractors, licensors, and their respective officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, products, or consultations; (b) your violation of these Terms; (c) your violation of any law or third-party rights; or (d) any content you submit.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination all licenses end immediately. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, and arbitration) shall survive.

16. Miscellaneous

These Terms were written in English (US). In case of conflict with any translation, the English version controls.

If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall remain in full force.

No waiver of any term shall be a continuing waiver. These Terms constitute the entire agreement between you and us regarding the Services and supersede all prior agreements.
